TERMS OF SERVICE

GENERAL TERMS

I retain the right to refuse any commission for any reason
-
any artwork created by Mawcraft will include the artist's signature which may not be removed or blocked
-
pictures of artworks may be posted to Mawcraft's website and social media outlets for advertising purposes

PAYMENT
-
commission prices are set in Canadian dollars (CAD)
-
commission payments are made through Paypal, which accepts all major credit cards
-
half of the total commission payment must be paid before the start of an artwork; the remainder of the commission payment must be paid upon completion of the artwork and before the artwork is delivered

PROCESS & DELIVERY
-
the time it takes to finish a commissioned piece varies depending on the size and complexity of the piece, in addition, but not limited to, other work and the health of the artist
-
small works can take weeks to finish, larger works can take months; when compiling the invoice for a commissioned piece, the artist will give an approximate timeline in which the piece might be completed, but this is subject to change
-
in the event of unforeseen circumstances that might delay the completion of a piece the client will be notified with a reason and a reasonable timeline for which to expect the completion of the piece
-
once the piece is completed the client will be notified by email, including an image of the completed piece.
-
once the client has been notified of the completion of the piece, the physical artwork will be sent for delivery through Canada Post (*the cost of shipping will be included in the invoice when determining the cost of the commission)
-
once the finished piece has been been handed off to Canada Post, the artist is no longer responsible for it's status or condition; any damages or delays that might occur are then the responsibility of Canada Post

REVISIONS
-
Copic designs are first outlined in pencil, shown to the client, and can be revised at this stage. Once the artwork is started using the Copic markers it cannot be altered due to the nature of the medium.
-
artworks using oil paint can be altered at the outline stage free of charge; any alterations requested after paint has been applied to canvas will entail an additional fee; no alterations may be requested once a painting is 50% complete (*the artist will notify the client when this stage has been reached)
-
drawings, including pencil, charcoal, and pastels, can be altered at the design/outline stage, but cannot be altered once shading/colouring has been started

COPYRIGHT & USAGE
I, Bryan Maw [the artist],
-
retain all copyrights over the commissioned artwork
-
will not profit further from the commissioned artwork unless you [the client] break any of the Terms of Service
-
reserve the right to post the commissioned artwork online, in my portfolio, as well other publications such as art books
You [the client]:
-
may upload the artwork to any website or social channels given you give credit to the artist
-
may NOT make profits from the commissioned piece (reselling, redistributing, making prints, etc.)
-
may NOT use the artwork for commercial purposes. The license to the commissioned artwork may be purchased at any point - contact Mawcraft for more info. *reproducing/using the artwork commercially means making money from it in any way not excluded from these terms
-
may NOT claim the artwork as your own
-
may NOT alter the artwork without the artist's consent

CANCELLATION & REFUND POLICY

I reserve the right to cancel and refund the order at any time and for any reason
-
the client is not allowed a refund on their deposit once a commission has been started
-
If I am unable to start your commission for any reason you will receive a full refund on your deposit
-
If you cancel your order before the commission is started, you will receive a full refund on your deposit
-
If you are getting a refund, do not request a Paypal chargeback; I will transfer the money back myself
-
If you request a Paypal chargeback at any point when you were not allowed to ask for a refund, you will lose all before-mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted from commissioning me again.
WHAT DO YOU GET?
-
direct input into the design of the artwork, including any reference photos you would like incorporated into the piece
-
insight and involvement into the colour plan (depending on the complexity of the commissioned piece)
-
regular updates on the progress of the piece, including images (sent via email)
-
a digital copy of the finished piece (.jpg, .pdf, or .png)
-
a physical copy of the finished piece (*sent through Canada Post)
